Job Seekers Allowance

Hello All. does anyone have any knowledge on the following. I was on Incapacity Benefit until June 2007. when they stopped it after one of those stupid Med 4 examinations, where you have to score 15 points or more, because i could lift my arms and legs up and speak i was declared fit and put on Job Seekers Allowance. Someone has told me that i should not be on Job Seekers i should still be on Incapacity Benefit until i return to work, they said the law changed in May 2006 and people with Cancer, M.S. or HIV. are deemed to meet the definition of disability without having to show that they have impairment as from diagnosis, and even when you go into remission this law still stands. So what my pal is saying is i should never have come of Incapacity Benefit and they had no right to make me have a medical? There is a good site www.cipd.co.uk and this is mentioned on page 10. if i understand it properly. thanks any info appreciated. best wishes to all.

hi kippy, when i was diognosed in 2006 i was on ssp and when that ran out tried to claim incapacity benefit but was turned down as they said i didnt qualify,so was put on income support which i still on as i havent yet returned to work , the benefit system is so complicated, the people at mcmillan can help you with claiming grants etc,as they did for me. hope you get on ok love lynn x

Hi Kippy,

When I was diagnosed in 2005 I was first on SSP and when that ran out I was put on income support who then decided that part of my money was for incapacity benefit. How confusing was that?
I was also told that I should not claim Job seekers allowance but that I should remain on income support until I return to work.
But the bestest people who can advise you and me are indeed McMillan cancer people.
They gave me the best advice of all and also are very practical in all cancer matters.
Hope you get the best advice.
