More work woes......................

My ex employers contacted me on Thursday, 4 days after I terminated my temp contract with them. They asked me to explain what had happened (the usual thing, everyone concerned has been questioned and says as far as they were aware I didn’t have any problems). I think the HR lady got a bit of a shock because I stuck up for myself and fought my corner, I even quoted a bit from the DDA as I had read up on it last week. She got a bit flustered and admitted that there were things that they probably could have handled better to do with appointing me; she also admitted they had not taken anyone on before who had just had lengthy time off due to cancer.

Turns out because I wrote them a letter outlining my problems, I have now kick started the grievance procedure and they now have to write to me to ask if I want to pursue this. What a pain, I don’t know what to do for the best, but I think I might ask my solicitor to take a look over the letter when it comes, also to give me some advice.

Why is nothing ever simple with this illness?

I suspect they are covering themselves as they are worried that you may claim constructive dismissal under the DDA. You put your problems in writing and that would be assumed to be a grievance. If they don’t investigate and you did make a complaint to an employment tribunal, any award you get would be increased as they had not followed the statutory grievance procedure.
