Anyone been discriminated against by their employer?

Hey all,

Hope you’re all coping in the heat. I have a very sensitive situation that is indirectly related to my breast cancer journey. I am still on the cancer pathway with a double mastectomy and DIEP planned for the end of the year (BRCA2). Last week I wa told that my job was being made redundant, I believe I am being discriminated against having spoken to ACAS/CAB and an employment lawyer. They (of course) have denied this despite evidence. They offered me a settlement amount (very low) which I rejected and counter offered with (reasonable IMO) and they have rejected that asking me to come back with something else. Can anyone recommend a lawyer who specialises in discrimination/disability law please? Or if anyone has any experience on this field and can advise, I’d be so grateful :pray:

This is causing me so much anxiety and stress and despite working throughout chemo, surgery and radio, it has pushed me to my limit.

I don’t know of any lawyers, but I would definitely contact Macmillan’s free helpline as they deal a lot with employment issues and will be able to give advice or point you in the right direction.

Hi there - I am so glad I saw this post as I am going through a similar situation, except I am now post-treatment and was planning to return to work.
I spoke with ACAS but I am going to contact CAB and MacMillan for more advice. If I find a good a good lawyer or find any more useful info, I will post it here.

Hello everyone,

I too feel like I have been discriminated against, bullied etc since my diagnosis. I’ve spoken to ACAS and CAB and what they say is in line with my thoughts but I’ve spoken to two solicitors now who have both advised that I basically put up and shut up.

Did anyone get anywhere with solicitors? The Macmillan employment support line has closed due to funding :frowning: CAB are giving advice but I don’t think I can take this on alone and represent myself.

I had a similar issue with my manager after my diagnosis—they didn’t handle things well at all. I ended up talking to someone at preszlerlaw.com, and it helped me understand where I stood legally. Sometimes just knowing your rights and what’s considered discrimination makes a huge difference. It gave me the confidence to push back when things got unfair.

Hello everyone, its an awful thing to say but i am so pleased to read all the articles and replies because i have been going through hell the past two months. I work for a county council which i have done so for 6 years, during this time has triple positive BC. Part of my role was to take minutes however due to side effects of the treatment i suffer with neuropathy in my hands and feet, and joint pain. Underwent Occ Health assessment at work which stated i was no longer able to take minutes. Recently business restructure has left me being downgraded and failed the two interviews for both jobs i have been doing on my own for 14 months. I have been told that they are unable to provide any reasonable adjustments for me to carry on my role, and for both interviews they did not allow me any additional time as stated under the Disability Act. I have gone to the union but have advised me not to take any further due to the additional stress it will create for me, but i feel very strongly that i am being penalised through no fault of my own with having cancer and the ongoing side effects. I am honestly devastated about being moved to a different department and not doing the job i loved. Any further guidance would be appreciated. Take care everyone xx

Bolly that sounds terrible and pretty obvious discrimination to me. I too found my Union to be unhelpful. I’m getting pretty sick of people thinking they know what’s best for me. I know that the stress of letting it go would affect me far more than doing what I know is right!

Speaking to ACAS and the employment specialist at CAB did help me and I eventually found a solicitor that didn’t belittle me and has actually given me the confidence to pursue it all independently (at least at the moment!)

@mrsbee2 Are you in a Union? If so, contact them and they will support you.

If not, do you have any family members that are in a Union? Some Unions have access to free legal advice which family members can take advantage of too.
