I was off work last year whilst receiving treatment and therefore missed the appraisal cycle. I would have been due to move up the pay scale at work after the completion of the cycle but obviously, as I was off, I have no documentation to produce. Does anyone know if I would have a case under the DDA? I now feel I may be at a financial loss through no fault of my own.
try the equality and human rights commissiom or acas. I’m pretty sure that they have to make ‘reasonable adjustments’ and that you should not suffer disadvantage. I know if a woman is on mat leave for example, she would recieve normal pay increase etc
Thanks for the reply Georgibella! That’s a good point actually - I shall check with colleagues and see what has happened to them post maternity leave! (Not quite the same thing I know but it might help to strengthen my case).

Cancer is now included under the DDA, so definitely worth exploring. Like Georgibella, would feel very hopeful you do have a case.
BCC had something about employment guidelines on this site somewhere (or maybe it was Macmillan). Maybe ring up BCC or Macmillan helplines as I think they’d know all about rights for people with bc. And good old Citizens Advice too.
That’s absolutely outrageous!
Very best wishes for fighting this (just what you need, another fight…)
It would appear that the clarification that came back was that I infact will be eligible for consideration for moving up the pay spine. My faith in humanity has been restored!!!
thats good to know as its my incremental date today so hope i go up to the next pay spine too… will know more at the end of the month when i get my payslip.
Hi, I’ve been off for the past four months following diagnosis, and am pleased to tell you that I got a pay rise (incremental) in my August pay. I work for the civil service, which I think sometimes helps!
