Hi had a bilateral masctomy in 2015  chemo rads ect, I currently valet caravans and it’s very physical work, I ve been off for ten weeks following a hemotoma op , I m supposed to go back to work on Wednesday I don’t want to, the boss won’t give me lighter duties?  There’s been five members of staff left since new owners in June bearing in mind the staff is only thirty ? Question do I go back and suffer tiredness and feeling like poo or do I give up and loose a regular wagexx

Hi Kazglass

Having had cancer is seen as a disability for employment matters, so your employer should make “reasonable adjustments”, which could be lighter duties, fewer hours, shorter days etc? They may not be aware of this so you need to arm yourself with all the info and then have a chat with them. I’m assuming there isn’t an HR department where you work? If so, then you need to talk to them first as they should know all this. Don’t rush into leaving a work until you have explored all the options, even if it is just a temporary solution until you find something that suits you better . I’m not sure if there is a time limit on being classed has having a disability as you had your treatment in 2015 but if the hematoma op was connected then you should be covered. Have a chat to BCC on their helpline and hopefully someone on here with better HR knowledge than me can advise. X

There is no time limit re diagnosis, all cancer patients even in remission are classed as disabled and protected under the equality act.
