Just woken from another disturbed night worrying about the threat of legal proceedings against our family. The worry to me seems to be on a parr with my diagnosis with BC last year which was Grade 3, Stage 2. Have been through everything, op, chemo, rads etc and have just had a mamo check up and am awaiting the results in 2 wks. Also having funny pains in joints which will talk to Consultant about too!
Wondered if there are any kindly solicitors/barrister/legal experts out there that would mind giving us some advice, just to get us on the right path as we have no clue where to start.
The claim is for breach of contract and defective workmanship so I think this falls into the catagory of ‘Building Disputes’- my husband is a Landscaper and the claim is from a client.
I won’t go into detail here and this forum is a long shot really. I know we will now need to employ a solicitor but hoping that some initial advice from an expert might help.
When you are a worrier, you all know that having BC wakes you up, worrying and pondering and worrying. I thought that this type of worry had subsided now being a year down the line but this family crisis has topped the lot.
We are a normal family and the nutter that has made the claim we have found out, done this to a previous builder! He’s on a no win no fee basis.

I’m sorry you have all these extra worries to cope with on top of the BC. I’m not a solicitor but have you thought of trying your local Trading Standards office, some of the officers are vey helpful (not all!) and they know quite a lot about fair trade and contract law.

Roully I am so sorry you have this worry. I wonder if the Citizen’s Advice Bureau might be able to help you find legal advice if you don’t know where to start?

Is your husband a member of a governing/trade body? If so they will be your first port of call… Secondly I assume your husband has Liability Insurance? As usually within that you will get free legal assistance.
Hope that may help a little, I am currently trying to help my OH fight for his job as he may be being laid off next week, it never rains but it pours eh?

Thanks to all you lovely ladies for your support. Yes my OH is a member of the Federation of Master Builders. When this cropped up, they wrote to the client to instigate their dispute resolution procedure. He did not respond, just went straight to a solicitor. My OH has public liability and they helped initially but now they are claiming that it’s up to us. Having a fight with the insurers as well!
The nutter client is a wealthy businessman and he probably got a friend surveyor to do his report and he probably has a friend solicitor dealing with this too. He knows what he’s doing. My OH thought something was funny when he started the job in some of the comments he made! Incidentally we have a surveyors report counter acting his report but that makes no difference…his solicitors are still issuing procedings…I can’t believe how he is going to get away with it…he knows we would never be able to afford to fight it in court.
thank you again…at least all this worry is making me sick to my stomach, enough that I can’t eat…I can do with some weight loss which tamoxifen has helped pile on!
