Termination of contract in probation period cos of chemo?

Hi

Does anyone have any advice about my employer being able to terminate my 1 year contract, because just before the end of my 3 month probation period I need chemotherapy treatment? Even though I am hoping to work as much as i can through it?

Any info would be gratefully received.

I hope someone can really help with this one for you (I’ve been out of Personnel for a few years now) but at first glance, this has got to be a no-no!

Oh course, it depends on the actual job & contract etc and what sort of time off you’ve perhaps already had off, but I would say that an employer can’t terminate anyone for something that hasn’t materialized yet (time off basically)and not just because of their perception of Chemo or someone else’s past experience. Everyone is affected differently - a nurse told me on Friday that she had patients who had Chemo in the morning and went to work in the afternoon - all the way through their treatment.

Have you been told, or got it in writing that reason is due to forthcoming chemo?

Zippy - Macmillan may be able to help you out here - you do have employment rights, and cancer can fall under the disability discrimination rules… so do look into it and see what you can do. Citizens Advice is the other place I’d go - but call Macmillan first. And good luck.

They were really helpful re what reasonable adjustments an employer had to make. Macmillan, as Sophie said, are great also.
I have managed to work through chemo but hours have been reduced since I started Tax.

I was also under impression you would be protected by the Disability Discrimination Act.
