I am doing a phased return starting in 2 weeks. I already feel anxious as i do for every phone call from my manager.
I don’t feel ready but like others sick pay has come to an end and manager is now talking illness dismissal . Not just any illness dismissal
!!!
I have worked for this company for 15 yrs. I am trying to be positive but don’t know how I’ll cope
Trying to get back to normal x
@jackie_plappert53 Hi Jack
That is absolutely awful! Why are they discussing illness dismissal before starting the phased return with reasonable adjustments? Have you seen Occupational Health (OH)? It is crucial that they don’t take you to a capability procedure, as it is very easy for companies to get rid of employees through that process.
Have you considered raising a grievance for harassment and lack of duty of care?
I think that MacMillan has a helpline to provide workplace and legal advice, as well as ACAS. Are you part of any trade union?
All the best my comrade
Please contact www.workingwithcancer.co.uk
Who can help you and your employer about how you are covered under the Equality Act 2010.
You can get the doctor to sign you off if you’re not ready, it not just about physical health but mental health. You can apply for Employment and Support Allowance ( two types, means tested or contribution type) as well as Personal Independence Payment ( not means tested). You will have to complete lots of forms and they will decide if you’re eligible.
I hope you get some support
The company doesn’t recognise unions and I’m sure like a lot of you fighting cancer and working on recovery is enough without having to fight for your rights as well.
I am jyst not strong enough mentally although i would be the first to encourage others.
You go girls x
Hi Jacq,
I know exactly what you mean I feel like I have been fighting to survive every day!
My employer has regraded my position (it has been done organisation wide) while I have been off having a fully mastectomy and reconstructive surgery. The document to let me know came out the day prior to my surgery and I just don’t have the brains or the fight in me to go against their decision. I called ACAS but they said they can do this while I’m off.
Hang in there Jacq whatever life holds feel free to feel how you do
